FAQ Regarding Review of Regulations

Some aspects of Regulations must continue to apply. 

Because the new regulations come into effect on 1 December, as passed into law in July, some aspects of the regulations must continue to apply regardless of any review of the regulations. For centres this means that for any new centre licensed from 1 December 2008, the 2008 regulations and criteria apply.

For home-based services it means that from 1 December:

  • all home-based services are deemed to be licensed
  • education and care can be provided in a home nominated by the child’s parent, instead of only in the child’s home, or the home of the educator
  • an educator’s own five year old child who is enrolled in school will not be counted in the maximum number of children allowed in the home-based setting
  • home-based services will also continue to comply with the Education (Home Based Care) Order 1992
